Ministry of Labour UAE (MOL)

Mostly the labor force of the United Arab Emirates involves workers from foreign countries. The Ministry of Labor UAE is the whole department that sees over the workers and governs all the work-related problems and hires the labor force from all over the world. The Ministry of Labor UAE manages the work permits, issues them, and bans the specific people from work permits. Whereas the UAE immigration department manages the residence visa permit. But the immigration department needs the approval of the MOL to issue the entry permit to the labor force. This whole process can be time-taking as different departments are involved.

To consult or complain about any work-related problems, including the contract information, about work permits or labor cards, you can contact:

Ministry of Labor UAE complaints

Ministry of Labor UAE (MOL)

If you have any complaints regarding the work conditions, coworkers, or the employer, you must contact the Ministry of Labor UAE for filing the claim.

Situations where you should contact the Ministry Of Labor UAE or the police:

  • If you are feeling threatened in the workplace
  • If someone is trying to harass you
  • If someone is abusing you physically or verbally
  • If you are a victim of a workplace assault
  • If someone is intimidating you into doing something illegal
  • Delay in the payment of commissions or salaries
  • Unauthorized retention of relevant documents by the employer
  • Unequal transaction distribution by the employer
  • Inaccurate calculation and distribution of commission
  • Abuse of power
  • And other violation to the rights of labors

In these drastic situations, you must contact the police and the Ministry of Labor before leaving your job without informing the authorities.

If you are facing this situation in your workplace, you might have to follow the steps below:

  1. Call the Ministry of Labor helpline for more clarification on your case and provide a summary of the problems you are facing every day at your office.
  2. To have more immunity and safety, try calling in a lawyer for yourself to get more legal information and know how the system works.
  3. Calling your lawyer is better as the consultation over a call will be free of cost. You will get all the information required to build up a complaint. Visiting a lawyer for discussion might be very expensive in the UAE. So try calling the lawyer or lawyers for acquiring the legal information.
  4. You can also visit the Tasheel Office or Tasheel Online to file your complaint or get more information regarding your case.

Tasheel is a trademark of the Ministry of Human Resources and Emiratization (MOHRE). It is a government-backed system that assists in labor-related processes. It ensures an improved way of dealing with the labor processes in the UAE.

You can file a complaint against your employer or coworker if you face any violation of employee rights.

  1. Tasheel services assist you in giving you direct access to the government services without any third party interference, which saves you time and money. The service specialists have the knowledge and expertise in labor laws and rights; that is why it is the simplest way to register a complaint via Tasheel. Also, you can track the progress of your case through the online Tasheel Service.
  2. To do so, you need to submit a copy of your passport or Emirates ID and the higher authorities’ phone number at your company.

While you will be filing a complaint against the people responsible, it is comprehendible that they will also react to the claim either by giving discussion a chance or counter-reports you for something you did not do. It is just to be intimidating to the party that registers the complaint first, which is an absolute abuse of power. In this way, you must have a solid case built up on your side, and you should be ready for any interventions from the other party to clean their name. This process can cost more money and time of yours.

For the custody of the passport forcefully retained by the employee, one must have to register a complaint. This process could include some visits to the court and police to force the employer to give the passport back to the one who is the holder. In the consequences of this process, you might be fired from your job as this act can portray a bad image of the company that they forcefully snatch your passports.

For the complaint regarding unpaid or delayed salaries, it could be challenging to get the money if the employer has run out of cash or either he has gone out of the business for some reason. So if during the MOL meeting he comes with some money you better have to take it, or else you will not even get that amount later.

For the cases of unfair dismissal of the employees, you stay terminated. Still, it is your right that you will get the entire amount due. This process can be costly and time taking. According to the MOL rules and regulations, if the court finds out that the employer unfairly dismisses you, you might have to prolong the hearings until you get the job or the money back. This process is going to cost you much more than that of the amount due to you. If you are dismissed without the pay, then your money will be recovered through the court.

If you get fired as a result of your complaint against the employer, it will be seen as an unfair dismissal case that will give you your due compensation money as per the Ministry of Labor UAE labor law Article 122 that says that… More particularly, termination shall be regarded as arbitrary if it is prompted by a formal complaint filed by the worker with the competent authorities…

Ministry of Labor UAE Visa Cancellation

Ministry of Labor UAE Visa

The Ministry of Labor UAE Visa Cancellation process is basically under the supervision of the company’s employer that offers you a job in the first place. They will arrange the cancellation of your residential visa and the work permit when you are about to leave the workplace or the country. The visa cancellation process includes the dissolution of the bank accounts affiliated with the company, returning the credit cards given by the company, subscription for telephones and other utilities offered by the company to the employee. It can be helpful as the authorities are involved on their own, and you have to worry less. But if you are just changing the workplace and not the country and need to have the telephone line and the bank accounts, you can negotiate with your employer if he can do you a favor on this case. When you turn your resignation in, it is pretty standard for your employer to inform your bank of your departure, so in that case, the account will be frozen right away. So either open another account in another bank or just withdraw the cash beforehand. You are working for the money, so make sure that your money is safe.

You must carefully consider your departure procedure before you turn your resignation in. Ensure that all of your assets are in your hand before you leave the company entirely. You do not need any complications before leaving the workplace, so you should double-check all the scenarios beforehand.

  • Have your hands on the money in the bank before handing in your resignation; you will not be having any access to your bank account.
  • Pay off all the loans that you owe to someone.
  • Know the date of your credit card cancellation.
  • Get your bonus and salary that you are due before leaving.
  • Leaving the accommodation that is provided and when you will have to leave it. For the housing and other utilities and their expiration, go through your contract to know how and when the contract will be annulled.
  • Telephone connections, electricity, water, or internet connections that you had, and when they will be cut off.
  • Shipping the goods that are to be sent beforehand.

Visa Cancellation Grace Period:

After the cancellation of your residence visa, you will have approximately 30 days to exit the country. Otherwise, you will be fined almost 25 dirhams per day for the first six months. The fine will gradually increase as your days of stay will increase. You can check the visa cancellation grace period of the place you are living. It is rational to leave the country under this grace period of 30 days, or else the law enforcement agencies can and will bankrupt you with the fines.

If the company’s employer denies your visa cancellation petition, then you have rights on your side to file a complaint against the company at the Disputes Department of the Ministry of Labor UAE.

If the flights are delayed or canceled, you might be offered some leniency from the Ministry of Labor UAE Visa Cancellation department.
